Arrest for Felon with a Firearm

A suspect is in jail this morning after firing a gun in Hidden Lake last night and deputies determined he was a convicted felon.

On February 24th at 8:46 p.m. deputies responded to a residence in Hidden Lake subdivision for what was initially reported as a shooting of a person. A resident of the home reported Joshua Payne, 44, was armed with a handgun. As the resident and a young child exited and fled the home, Payne fired off a shot.

A perimeter was established around the home and deputies attempted contact through the home phone, cell phone and announcements over the public address system of a patrol car. Payne would not respond to any of the communication

Deputies determined Payne was a convicted felon and is prohibited from possessing a firearm. Deputy E.T. Osborn obtained a warrant for possession of a firearm by a convicted felon as the crisis negotiation team continued to attempt contact with Payne.

At 11:17 p.m. negotiators were able to speak with Payne by phone and he relayed a friend had picked him up and he was in Fauquier County. After a few minutes, he hung up the phone. Deputies were certain he was still in the home and continued negotiation attempts.

At 11:45 p.m. the Sheriff’s Office armored Bear Cat moved down the roadway past the residence and Payne exited the home. He surrendered peacefully to the arrest team. The suspected handgun was recovered from the residence.

Payne was incarcerated at the Rappahannock Regional Jail without bond on the charge. This is an ongoing investigation.
