Suspect Arrested following Domestic Situation Involving a Weapon

Stafford, VA. A suspect was taken into custody on Thursday morning by deputies with the Stafford County Sheriff’s Office for assaulting a female subject with a weapon.

On September 12, 2019, at approximately 5:22 a.m., Deputy Aubrecht was parked in the area of 2650 Jefferson Davis Highway when he was flagged down by a female subject. The female subject was distraught and told the deputy she was involved in a domestic situation at her residence located on Tolbelt Court.

She advised that at approximately 9:00 p.m. that night her boyfriend struck her head with a handgun, causing a laceration, and then placed the weapon in her mouth. Afterwards, he holstered the gun and put both hands around her neck and began choking her. He also closed the bedroom door and told her she could not leave. He was heavily intoxicated and she was able to escape around 5:00 a.m. after he passed out in the bedroom.

Rescue personnel responded to the scene to render aid to the victim. In addition, Empowerhouse and a domestic violence advocate with the Sheriff’s Office also contacted the victim.

Units subsequently set up a perimeter around the residence. They eventually made contact with the male subject over the phone and told him to step outside. On several occasions, he exited the residence, but would quickly retreat back inside. When the suspect exited the residence for a third time and continued to fail to comply with the deputies’ commands, Deputy Truslow deployed his K9 partner, Havoc, who apprehended the suspect.

James Davis, 60, of Stafford was taken into custody and incarcerated at Rappahannock Regional Jail without bond. He is charged with domestic assault and battery, abduction, strangulation, felon in possession of a firearm, use of a firearm in commission of a felony, malicious wounding, and brandishing a firearm. Additional charges may be pending.
