Reckless Handling of Handgun at Hotel

A Stafford man was arrested this weekend after firing a handgun from a hotel balcony like the Looney Tunes character Yosemite Sam.

On June 4th at 11:43 a.m. Sergeant A.I. Assur and Deputy T.M. Givler responded to the Super 8 at 25 Wicomico Drive for a past occurred disturbance with a weapon. Staff at the hotel relayed a guest had reported hearing gunshots around 2:00 a.m.

Deputies reviewed surveillance video and witnessed a group of subjects on the hotel balcony at 1:57 a.m. who appear to be taking photos holding a handgun. The selfie soiree ends at 2:10 a.m. when a subject identified as Josue Guardado Garcia, 31, took the weapon and leaned against the railing outside the second floor room. Although there is no audio, deputies observed what appeared to be a shell casing eject above Guardado Garcia’s head. The weapon owner proceeded to take the gun back and the group dispersed back to their respective rooms.

Deputies located the gun owner in his motel room, seized the weapon and continued their investigation. Guardado Garcia was not on scene, but staff promised to contact the Sheriff’s Office when he returned. At 1:55 p.m. deputies learned Guardado Garcia had returned and a possee was dispatched to effect the arrest.

Guardado Garcia was charged with reckless handling, brandishing, shooting in a public area and shooting in a no shooting zone. He was held at the Rappahannock Regional Jail on a $3,000 bond. Deputies were unable to locate any people or property injured by the errant rounds.
