Convicted Felon Arrested on Gun and Drug Charges

Deputies responded to a single vehicle accident on Saturday and found the driver under the influence and in possession of a gun and drugs.

On August 7 at 8:06 a.m., Deputy W.M. Isenberg responded to the area of Jefferson Davis Highway and Tracey Street for a single vehicle accident. Upon arrival, Deputy Isenberg located the F-150 off of the roadway and stuck in the mud. Deputy Isenberg approached the driver, Robert McIlwain, 32, of Alexandria, who was outside of the vehicle. When McIlwain saw the deputy, he began to climb through the driver’s side window and reach towards the inside of the door. As Deputy Isenberg opened the door and removed McIlwain from the vehicle, he noticed a handgun in the area where McIlwain was reaching towards. Upon discovering the firearm, Deputy Isenberg detained McIlwain.

Deputies noticed McIlwain appeared to be under the influence. Deputy R.A. Weatherholtz arrived on scene and began a DUI investigation while Deputy Isenberg conducted a search of the vehicle. During the search, controlled substances were found in the center console and in a bookbag located in the backseat. A digital scale was also located.

During the course of the investigation, deputies discovered McIlwain is a convicted felon. He was charged with possession of a controlled substance with intent to distribute, possession of a firearm by a convicted violent felon, possession of a firearm while in possession with intent to distribute, possession of a controlled substance, driving under the influence-2nd offense within 5 years, and driving on a revoked license. McIlwain was held without bond at the Rappahannock Regional Jail.
