On June 1, 2017, Deputy K. P. Lytle was traveling southbound on Route 1 in the area of Sage Lane and observed a Chrysler 300 displaying an expired registration in front of him. The vehicle also had an old and faded rejection inspection sticker on the windshield. The deputy initiated a traffic stop and when he approached the vehicle, he detected the odor of marijuana. He also observed three young children in the back seat of the car, all belted in but none in car seats. Two of the children were old enough to carry on a conversation and one was only one year old.

The driver of the vehicle immediately admitted to Deputy Lytle that his license was suspended. Deputy Lytle questioned him as to why the children, in particular, the one-year-old was not secured in a car seat as required by law. The driver stated the children’s mother had the car seats and had not given them to him. Deputy Lytle further noticed that the one-year-old was only strapped in with a lap belt.

As the driver was suspended, he and Deputy Lytle made arrangements for a friend to respond with car seats to transport the driver and his children safely to their destination. Deputy Lytle confronted him regarding the marijuana and after a brief conversation, the driver produced a small bag containing approximately twelve grams from the car. Also seized was a marijuana cigarette that was in the ashtray.

Aquan Zinario Chapman age twenty-five was summoned for Driving while Suspended, Failure to Secure a Minor Child and Possession of Marijuana.
